These Terms and Conditions ("Terms") govern the repair services provided by Fair Repair ("we," "us," "our") at 1065 Dundas St W, Mississauga, ON L5C 1C3, Canada, and your use of our website at https://fairrepair.org. By leaving a device with us for service or using our website, you agree to these Terms. Please read them carefully.
1. Service Agreement
When you bring a device to Fair Repair for service, you are entering into a service agreement with us. This agreement is formed when you authorise us to proceed with either a diagnostic assessment or a specific repair. We will provide you with a written or verbal estimate before proceeding with any chargeable work beyond the initial diagnostic.
2. Diagnostic Assessment
Our diagnostic process involves a technical inspection of your device to identify the nature and likely cause of the reported problem. Diagnostic fees, where applicable, are charged for the time and expertise involved in assessment, regardless of whether you proceed with a repair. We will clearly communicate our findings to you before any repair work begins.
Important: Diagnostics identify probable causes based on the information available at the time of assessment. Some issues — particularly intermittent faults, software instability, or complex hardware failures — may not be fully apparent during initial inspection. We will communicate honestly about the confidence level of our assessment.
3. No Guarantee of Outcomes
Repair outcomes cannot be guaranteed. Electronics repair involves working with components that have existing wear, damage, or unknown prior history. While we apply our best skill and effort to every repair, we cannot guarantee:
- That a repair will be successful in all cases
- That a device will not develop further issues after service
- That all data on a device will survive or be recoverable
- That a repaired component will function indefinitely
We will always be transparent about the likelihood of success before you authorise work. If the prognosis for a repair is poor, we will tell you.
4. Data and Device Content
You are solely responsible for backing up any data on your device before submitting it for service. Fair Repair is not responsible for data loss that occurs during or after a repair. We take reasonable precautions to avoid unnecessary data exposure, but repair procedures may occasionally require actions that affect device data (such as operating system reinstallation).
We will inform you in advance if a repair procedure is likely to affect stored data and request your explicit authorisation before proceeding with such work.
5. Authorisation and Estimates
No chargeable repair work will be performed without your authorisation. Estimates provided before work begins are as accurate as possible given available information, but may be subject to revision if additional issues are discovered during the repair process. We will contact you if the actual cost is expected to exceed the original estimate and will not proceed without your updated authorisation.
6. Parts and Components
We use a combination of original manufacturer parts and quality-assured third-party components depending on availability and your preference. The type of parts used in your repair will be disclosed to you. Third-party parts are not affiliated with original manufacturers; quality and compatibility are assessed by our technicians.
7. Warranty on Repairs
Completed repairs carry a 90-day labour warranty covering defects in our workmanship. Parts warranties vary by component and supplier; we will specify the applicable warranty at the time of repair completion. This warranty does not cover:
- Damage caused by subsequent physical impact, liquid exposure, or misuse
- Issues unrelated to the original repair
- Normal wear and tear
- Damage caused by power surges or environmental factors
8. Unclaimed Devices
Devices not collected within 60 days of completion notification will be considered abandoned. Fair Repair reserves the right to dispose of or repurpose unclaimed devices after this period. We will make reasonable attempts to contact you before taking any such action.
9. Limitation of Liability
Fair Repair's liability in respect of any repair service is limited to the cost of that specific service. We are not liable for indirect, consequential, or incidental damages, including lost business, lost data, or loss of use, arising from service outcomes or device failure. This limitation applies to the maximum extent permitted by applicable law.
10. Website Use
The information on our website is provided for general informational purposes. While we aim for accuracy, we make no representations or warranties about the completeness or currency of any content. Use of the website is at your own risk. We are not liable for any damages arising from reliance on website content.
11. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
12. Changes to Terms
We may update these Terms periodically. The current version will always be available on our website. Continued use of our services after any update constitutes acceptance of the revised Terms.
